In our mission to make commerce better for everyone at BettaMax, we collect and use information about you, our:

  • merchants using BettaMax to power your business;
  • consumers who shop at a BettaMax-powered business;
  • partners and service providers who support merchants in building, operating, or improving their businesses, including third-party integrations; and
  • visitors to BettaMax’s websites, or anyone contacting BettaMax support.

This Privacy Policy and any supplemental privacy policies (together, the “Privacy Policy”) will help you better understand how we collect, use, and share your Personal Data.

“Personal Data” refers to information defined as “personal data,” “personal information,” or “personally identifiable information” (or similar terms) under applicable data protection laws.

Capitalized terms used but not defined in this Privacy Policy have the same meaning as in the BettaMax Terms of Service.

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or service offerings. Where such changes are material, we will notify you (for example, through the BettaMax platform or by email).

Our values

Trust is the foundation of the BettaMax platform and includes trusting us to handle your information appropriately. Three core values guide how we design and deliver our products and services. These values are intended to help you better understand how we approach your information and privacy.

Your information belongs to you

We carefully assess what types of information are necessary to provide and improve the Services, and we aim to limit our data collection to what is relevant and required. Where appropriate, we delete or anonymize information once it is no longer needed.

When developing and enhancing the Services, BettaMax works to incorporate privacy and security considerations into the design of our systems and processes.

Our approach is guided by the principle that your information belongs to you, and we aim to use such information in a manner that supports your use of the Services.

We protect your information from others

BettaMax does not disclose your Personal Data to third parties except where necessary to provide the Services, where you have authorized such disclosure, or where required by applicable law.

Where we are legally required to disclose your Personal Data, we will, to the extent permitted by law, take reasonable steps to notify you in advance.

We help merchants and partners meet their privacy obligations

We recognize that many merchants and partners using BettaMax may not have dedicated privacy or legal resources. As part of our Services, we aim to design our platform in a way that supports privacy-conscious use.

We may provide guidance materials, documentation, and support resources to help users understand and address common privacy-related considerations when operating their businesses through BettaMax. However, you remain solely responsible for ensuring your own compliance with applicable data protection laws and regulations.

Why we process your information

We process your information for purposes related to providing, operating, and improving the BettaMax Services, as well as for legitimate business needs of BettaMax and its service providers (for example, to deliver and support the Services).

Depending on whether you are a merchant, customer, partner, or visitor, you may refer to any applicable supplemental privacy notices to better understand the purposes of processing and the categories of recipients for each type of Personal Data.

We rely on different legal bases to process your Personal Data, including:

  • performance of a contract, for example to use your name and contact information to create and manage your Account and to communicate with you regarding the Services;
  • legitimate interests, for example to analyze how the Services are accessed and used, to maintain security, prevent fraud, and improve functionality;
  • compliance with legal obligations, where processing is required under applicable laws and regulations; and
  • consent, for example where you agree to receive marketing communications from BettaMax, which you may withdraw at any time. 

Your rights over your information

We believe that you should be able to access and control your Personal Data, regardless of where you are located. Depending on your relationship with BettaMax and how you use the Services, you may have the right to request access to, correction, deletion, portability, restriction, or objection to certain processing of your Personal Data. Exercising these rights will not result in any additional charges or reduced level of service. Please note that these rights may only apply in certain circumstances and may be subject to limitations under applicable laws.

Where BettaMax processes Personal Data on behalf of merchants (for example, in connection with transactions conducted through a merchant’s Store), you should contact the relevant merchant directly. Each merchant is responsible for how they collect and use your Personal Data, and you should refer to their own terms and privacy policy for more information. BettaMax may, in some cases, provide tools or reasonable assistance to merchants to help them respond to such requests.

If you have a direct relationship with BettaMax (for example, as a merchant, user, partner, or website visitor), you may submit a request regarding your Personal Data through the contact methods provided in this Privacy Policy. We may require you to verify your identity before processing your request and may use third-party service providers to assist with this process.

If you are not satisfied with our response, you may contact us to seek further resolution. Where applicable, you may also have the right to lodge a complaint with your local data protection authority.

Please note that BettaMax does not currently respond to “Do Not Track” signals, as there is no consistent industry standard for their interpretation.

How long we retain your information

BettaMax retains Personal Data only for the period necessary to achieve the purposes for which it was collected, including delivering, maintaining, and improving the Services.

When determining how long to retain Personal Data, we take into account various factors such as the type of data involved, its sensitivity, the potential risks associated with unauthorized access or disclosure, the purposes of processing, and any applicable legal or regulatory requirements.

In certain cases, we may retain Personal Data for a longer period where necessary to comply with legal obligations, resolve disputes, prevent fraud or abuse, or enforce our Terms and policies.

If you stop using the Services or close your Account, we will take reasonable steps to delete your Personal Data or ensure that it is no longer identifiable, for example by aggregating or anonymizing it, unless retention is required or permitted by law.

Retention periods may vary depending on your relationship with BettaMax, such as whether you are a merchant, customer, partner, or visitor.  

How we protect your information

BettaMax implements appropriate technical and organizational measures designed to safeguard your Personal Data and maintain the security of the Services. We regularly review and improve our security practices to help protect against unauthorized access, disclosure, alteration, or destruction of data.

Where relevant, we may engage independent third parties to assess the effectiveness of our security controls, including systems involved in processing sensitive information. However, no system or method of data transmission over the Internet can be guaranteed to be completely secure, and therefore we cannot ensure absolute security of your Personal Data.

Our use of automated processing and machine learning

BettaMax may use automated processing techniques, including machine learning, to support the operation and improvement of the Services. These technologies may be used, for example, to enhance user experience, improve platform performance, or detect potentially fraudulent or abusive activities.

Where such processing is applied, it is either carried out with appropriate human oversight, or in a manner that does not produce legal or similarly significant effects on individuals.

BettaMax does not rely solely on fully automated decision-making that produces legal or similarly significant effects, unless otherwise permitted by applicable law. 

Cookies and similar technologies

BettaMax uses cookies and similar technologies to operate, improve, and personalize the Services, as well as to analyze usage and enhance user experience. These technologies may also be used by third-party service providers that support our platform.

You can control or manage certain types of cookies through your browser settings or other available tools. Additional information about our use of cookies and similar technologies may be provided in a separate Cookie Policy, where available.

If your inquiry relates to how a merchant or store processes your Personal Data, you should contact the relevant merchant directly or review their privacy policy, as they are responsible for their own data processing practices.

United States Regional Privacy Notice

This United States Regional Privacy Notice (“US Notice”) supplements the BettaMax Privacy Policy.

This US Notice applies to individuals residing in certain states in the United States and is intended to help you understand how BettaMax collects, uses, and discloses your Personal Data, and how you may exercise your rights under applicable U.S. privacy laws, including but not limited to the California Consumer Privacy Act (CCPA), the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Utah Consumer Privacy Act (UCPA), and the Virginia Consumer Data Protection Act (VCDPA) (collectively, the “US Privacy Laws”).

What information we collect and share about you

To provide our platform and related services, BettaMax processes certain categories of Personal Data depending on how you interact with our services.

We do not “sell” your Personal Data as that term is defined under US Privacy Laws.
